The military judicial process is handled by commanders, not independent prosecutors. More than 90 percent of alleged rapists are not incarcerated. Retaliation against accusers is common. “Military leaders say they have a zero-tolerance policy for rape, but they have a zero-tolerance policy for those who report rape,” says attorney Susan Burke, 51, whose own firm helps—free of charge—service members who’ve been sexually assaulted to seek justice.
